Dear Michael:

Thank you for speaking with me on the phone just now.

Based on our conversation, your claim is for 104 hours of Vacation Pay and accompanying Waiting Time Penalties. You stated that your pay rate was $250,000 per year, which gives us an hourly equivalent of  $120.19. You worked under a written employment agreement.

Based on all that, here are the case issues which reflect the defendant's potential liability:

Vacation: $12,500.00 (104 hours at hourly equivalent of $120.19)
Waiting Time Penalties: $28,846.15 (Daily rate of  $961.54 from hourly equivalent of $120.19 and 8 hours per day; 30 days waiting time)

Total:  $41,346.15

Jackie,

Use this letter as my formal notice of resignation from Samuelson Tingo Construction, effective immediately (dated Monday, February 13, 2023.) The 7 a.m. morning phone incident on Sunday, February 12, 2023, has left me with no choice but to sever my business relationship with Samuelson Tingo Construction and George Tingo.

The verbal assault, screaming, yelling, and belittling that I was subject to during George’s phone call was completely unacceptable. As an employee and business partner, it is expected to be treated with respect and professionalism in all work issues and situations. Unfortunately, George’s behavior towards me was disrespectful, abusive and create a hostile work environment.

I take my work very seriously and firmly believe that a successful business partnership is built on trust, mutual respect, and effective communication. George’s actions on Sunday morning violated all of these principles, and as a result, I can no longer work with/for him.

In addition to the aforementioned incident, I have received a number of unintentional calls, you know, the typical “Tingo Pocket Dail” from Geroge in recent months, which have raised concerns regarding his integrity, honesty, and ethics. Furthermore, during those calls, George's conversation disclosed information regarding the website tingobuilders.com. Please use this letter as my “cease and desist” letter as that site content on Tingo Builders is to me offensive and embarrassing and should be removed immediately. Specifically, any photos or videos of myself and any related content that resembles specific language shown in my CV, such as project, names, and locations, all must be removed.

Lastly; I am entitled to two three weeks' [per signed offer letter, dated 12/3/21] vacation from the previous year, I was paid one, please send the remaining over.
